President Joe Biden has chosen not to enforce the impending TikTok ban, leaving the decision to President-elect Donald Trump.

In a move that shifts the responsibility of TikTok‘s future in the United States, President Biden has opted not to implement the scheduled ban on the popular social media platform. This decision effectively transfers the authority to determine TikTok’s fate to the incoming administration of President-elect Donald Trump.

Previously, President Biden signed legislation mandating that ByteDance, TikTok’s Chinese parent company, divest its U.S. operations by January 19, 2025, citing national security concerns. However, with the divestiture deadline approaching, the current administration has decided against enforcing the ban. This leaves the critical decision in the hands of President-elect Trump, who has expressed a more favorable stance towards the platform.

Mike Waltz, the incoming National Security Adviser, indicated that the new administration might consider extending the divestiture deadline if a satisfactory agreement can be reached. “We are open to exploring all options that protect American users’ data while allowing TikTok to continue its operations,” Waltz stated.

The Supreme Court recently appeared inclined to uphold the law requiring ByteDance’s divestiture on national security grounds. Despite this, President-elect Trump has acknowledged TikTok’s value, particularly highlighting its role in engaging younger demographics. He has signaled support for a resolution that ensures the protection of user data without necessitating an outright ban.

Senate Democratic Leader Chuck Schumer has advocated for extending the deadline to allow for a comprehensive review and potential negotiations. Conversely, Senate Intelligence Committee Chair Tom Cotton has opposed any extensions, emphasizing the importance of addressing security concerns promptly.

As the transition of power approaches, the future of TikTok in the United States remains uncertain. The incoming administration’s decisions in the coming weeks will be pivotal in determining whether the platform can continue to operate under new ownership or face potential restrictions.
